Netquizz is a pub trivia streaming service, created for subscribers. It allows subscribers to stream pub trivia shows over the internet to internet-connected TVs, computers, or other devices (“Netquizz Service”). The content created by Netquizz is only available through the Netquizz Service and is for use only by approved account holders.
These Terms of Use govern the use of our Netquizz service. As used in these Terms of Use, “Netquizz service,” means the service provided by Netquizz for the use of the website, and viewing the content contained within. This is including all features and functionalities, as well as all content and software associated with our service.
1. Free Trial and Payment:
1.1. Every venue is given a free trial period to experience the Netquizz Service. During the trial, no payment method is required.
1.2. After the free trial, the venue must submit payment to continue accessing and viewing shows on the Netquizz platform.
2. Subscription Plans and Payment Options:
2.1. Upon the conclusion of the free trial, to continue using the Netquizz Service, the venue must subscribe to one of Netquizz’s three different plans: weekly, fortnightly, or monthly trivia.
2.2. The venue can choose to pay for their subscription on a monthly or annual basis, depending on their preference and convenience.
3. Cancellation and Refunds:
3.1. If a venue decides to cancel their subscription, they will not receive a refund for any unused time remaining in their billing cycle.
3.2. The cancellation will take effect at the end of the current billing cycle, and the venue will no longer have access to Netquizz shows after that period.
4. Use of the Netquizz Service:
4.1. You must be at least 18 years of age to create a Netquizz account. Minors may only use the service under the supervision of an adult.
4.2. The Netquizz service and all content that is viewed through using the service are for use by the account holder only, and can only be used at the single venue the account was created for. During your Netquizz subscription we grant you a limited, non-exclusive, non-transferable right to access the Netquizz service and view the Netquizz content. A new account must be created for any additional venue(s) the account holder may choose to have the Netquizz service to be viewed. The Netquizz content is for streaming use only, and the user cannot download, disseminate, modify or share any of the Netquizz content.
4.3. You may view the Netquizz content only at the premises that the account is assigned to. You are not authorised to export, broadcast, or distribute the service at a different location. The content that may be available to watch will vary by geographic location, and will change from time to time.
4.4. The Netquizz service, as well as the library of viewable content, is regularly updated, and content may be removed or updated at any time.
4.5. You agree to use the Netquizz service, including all features and functionalities associated therewith, in accordance with all applicable laws, rules and regulations, or other restrictions on use of the service or content therein. You agree not to archive, reproduce, distribute, modify, display, perform, publish, license, create derivative works from, offer for sale, or use (except as explicitly authorized in these Terms of Use) content and information contained on or obtained from or through the Netquizz service. You also agree not to: circumvent, remove, alter, deactivate, degrade or thwart any of the content protections in the Netquizz service; use any robot, spider, scraper or other automated means to access the Netquizz service; decompile, reverse engineer or disassemble any software or other products or processes accessible through the Netquizz service; insert any code or product or manipulate the content of the Netquizz service in any way; or use any data mining, data gathering or extraction method. In addition, you agree not to upload, post, e-mail or otherwise send or transmit any material designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the Netquizz service, including any software viruses, malware, or any other computer code, files or programs. We may terminate or restrict your use of our service if you violate these Terms of Use or are engaged in illegal or fraudulent use of the service.
4.6. Netquizz software is developed by, or for, Netquizz and may solely be used for authorised streaming and viewing of Netquizz content.
4.7. All subscribers to the Netquizz service may be required to obtain licenses from relevant rights holders with respect to public performance of musical works and sound recordings. Each country, state and territory may have its own licensing requirements and by agreeing to these terms you accept responsibility for your obligations to acquire any such licenses.
5. Billing and Payments:
5.1. Billing Cycle:
5.1.1. The subscription fee to use the Netquizz service, as well as any other charges you may incur in connection with the use of our service, such as taxes or transaction fees, will be charged to your chosen Payment Method.
5.1.2. The fee will be charged on an auto-renew basis, either monthly or annually depending on the frequency you selected when choosing your subscription. The fee will be charged on the specified date outlined on your “Account” page within the Netquizz website. In some cases, your payment date may change, for example, if your Payment Method has not successfully settled or when you change your subscription plan.
5.2. Payment Methods:
5.2.1. To continue using the Netquizz service after the free trial period, you will be required to provide a Payment Method.
5.2.2. By providing a Payment Method, you authorise Netquizz to charge your chosen Payment Method associated with your account. If a payment is not successfully settled due to expiration, insufficient funds, or otherwise, and you do not cancel your account, we may suspend your access to the service until we have successfully charged a valid Payment Method.
5.2.3. For some Payment Methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of your Payment Method. Local tax charges may vary depending on the Payment Method used.
6. Licensing
6.1. Netquizz is a fully licensed service, in respect to the content we have licensed to use within the Netquizz Service. However, each venue is still responsible for obtaining the necessary music licensing to comply with the performance or broadcasting rights requirements in their jurisdiction.
6.2. It is the venue’s liability to check the licensing requirements and obtain the appropriate licenses from the governing bodies.
6.3. Netquizz holds no responsibility or liability for venues that play shows without having obtained the required music licenses.
7. Intellectual Property
7.1. Content Ownership:
7.1.1. The content available on the Netquizz Service, including but not limited to text, graphics, logos, images, audio clips, video clips, software, and other materials, is owned by or licensed to Netquizz and is protected by copyright, trademark, and other intellectual property rights.
7.1.2. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Netquizz Service, except as necessary to use the service as intended.
8. User Responsibilities and Prohibited Activities
8.1 Compliance with Laws:
8.1.1 You agree to use the Netquizz Service in compliance with all applicable laws, rules, and regulations.
8.1.2. You are solely responsible for ensuring that your use of the service does not violate any third-party rights or any laws or regulations in your jurisdiction.
8.2. Prohibited Activities:
You are prohibited from:
8.2.1. Accessing or using the Netquizz Service for any illegal, unauthorised, or unethical purposes.
8.2.2. Interfering with or disrupting the integrity or performance of the Netquizz Service or its associated software and systems.
8.2.3. Circumventing any technological measures implemented by Netquizz to protect the content or enforce these Terms of Use.
8.2.4. Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code or underlying algorithms of the Netquizz Service.
8.2.5. Engaging in any activity that may impose an unreasonable burden or load on our infrastructure or interfere with the proper functioning of the Netquizz Service.
8.2.6. Engaging in any activity that violates the privacy or rights of others.
9. Disclaimer and Limitation of Liability
9.1. Disclaimer of Warranties:
9.1.1. The Netquizz Service and its content are provided on an “as-is” and “as available” basis without warranties of any kind, either express or implied.
9.1.2. Netquizz does not warrant that the service will be uninterrupted, error-free, or free from harmful components.
9.2. Limitation of Liability: In no event shall Netquizz, its affiliates, directors, officers, employees, or licensors be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of the Netquizz Service or the inability to use it.
10. Indemnification
10.1. You agree to indemnify, defend, and hold harmless Netquizz, its affiliates, directors, officers, employees, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from your use of the Netquizz Service or any violation of these Terms of Use.
11. Final Provisions
11.1. Severability: If any provision of these Terms of Use is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from the remaining provisions and shall not affect their validity and enforceability.
11.2. Changes to the Terms of Use: We may update these Terms of Use from time to time without prior notice. Any changes will be effective upon posting the revised Terms of Use on our website.
12. Entire Agreement:
12.1. These Terms of Use constitute the entire agreement between you and Netquizz regarding the use of the Netquizz Service and supersede all prior or contemporaneous understandings and agreements.
